Seller Agreement

This Seller Agreement is between Nosh2Go LLC (“Nest Commons”, “we”) and every business that sells on the Nest Commons marketplace (“Seller”). By applying and listing products, the Seller accepts this agreement and the policies linked below.

1. Eligibility

Sellers must be legally registered businesses, pass Seller Verification and keep their information accurate and current.

2. Listings

  • Only genuine, lawful, new products that the Seller has the right to sell.
  • No item from the Prohibited & Restricted Items list; no counterfeit, replica or trademark-infringing goods.
  • Accurate titles, photos, prices, stock and specifications; no false claims, fake discounts or fake reviews.

3. Fulfillment and service

Ship within the handling time in the Shipping Policy, upload valid tracking, accept returns per the Return & Refund Policy and reply to Nest Commons support within 48 hours.

Shipping fees

The Seller sets its own shipping fee in its store settings (a fee per order and, optionally, a free-shipping threshold). The Seller must: (a) keep the fee accurate and current, because it is shown on every product page and in the cart before checkout; (b) never charge hidden fees, handling surcharges or any additional amount after the order is placed; (c) keep the fee on the website identical to the fee sent to shopping channels — Nest Commons publishes it in the seller product feed (shipping per seller), so any change must be made in the store settings, not elsewhere. Nest Commons recommends, but does not require, free shipping on orders over $50. Shipping fees are not subject to commission.

4. Payments

The Seller is the merchant of record for its orders. Nest Commons accepts Airwallex only: the Seller must hold an Airwallex business account that Airwallex has verified, in the Seller’s verified business name, connect it to Nest Commons, and receive customer payments directly into it. Customers may pay by Visa, Mastercard, American Express and Discover cards, Apple Pay, Google Pay, Klarna and Afterpay as enabled in the Seller’s Airwallex account. Refunds are issued through Airwallex to the customer’s original payment method. The Seller is responsible for complying with its payment provider’s terms and for its own refunds, chargebacks and payment fees. Listings are not purchasable until a payment account is connected. Sellers must not take payments outside the Nest Commons checkout. Details: Seller Payments & Fees.

5. Fees and invoices

The Seller pays the commission in Fees & Commission (15% by default). Commission is recorded on each order and invoiced monthly; invoices are payable within 14 days. Buyer Protection refunds that Nest Commons pays on the Seller’s behalf are added to the next invoice.

6. Buyer Protection and disputes

Sellers accept the Buyer Protection Guarantee and Dispute Resolution decisions and must issue refunds that Nest Commons decides are due within 48 hours. If Nest Commons refunds a customer on the Seller’s behalf (for example when the Seller does not respond to or refund an approved Buyer Protection claim), the refunded amount is added to the Seller’s next commission invoice, payable within 14 days; while that invoice is overdue, checkout for the Seller’s listings is paused.

7. Customer data

Customer data may be used only to fulfill the order. Marketing to customers outside Nest Commons is prohibited.

8. Performance, suspension and termination

We may hide listings, pause checkout for the Seller, or close a Seller account for policy violations, overdue invoices, high cancellation or dispute rates, or valid IP complaints. On termination, open claims and unpaid invoices remain payable by the Seller.

9. Indemnity and law

The Seller is responsible for its products, taxes and legal compliance and indemnifies Nosh2Go LLC against claims arising from its listings. Contact: [email protected], 1500 N Grant St, Ste N, Denver, CO 80203, United States.
